These Terms of Use (“Terms”) govern your access to and use of Abscribe (“we,” “our,” “us”). By using our platform, you agree to these Terms.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of unauthorized access to your account.
  • You are also responsible for complying with all applicable laws and the terms outlined in these Terms of Use while using the platform.

Subscription Plans

We offer the following subscription plans:

  • Free Plan: Provides limited access to our application features with capped usage. This plan remains active until you choose to delete your account.
  • Pro Plan: Grants access to all premium features with a monthly or yearly subscription option. Usage limits apply as per the Pro plan's terms.
  • Business Plan: Designed for higher usage requirements, this plan also includes all premium features and is available with monthly or yearly subscription options.
  • Pricing Changes: We may adjust pricing for subscription plans with prior notice. Changes to pricing will not affect current subscribers until their next billing cycle.

Please note that all subscription plans automatically renew unless canceled through your account settings. Detailed terms for each plan, including any applicable usage caps, can be found on our pricing page or during the subscription process.

Billing and Cancellation

  • Auto-Renewal: All subscriptions auto-renew at the end of each billing cycle unless canceled through your account settings.
  • Cancellation: You can cancel your subscription at any time via your account settings. Upon cancellation, the subscription will remain active until the end of the current billing cycle, after which it will not renew.
  • Failure to Cancel: If you do not cancel before the renewal date, your payment method will be charged for the next billing cycle.

Refund Policy

  • Non-Refundable: All subscription purchases are non-refundable. This includes partial billing periods; we do not offer prorated refunds for unused time or features.
  • Cancellation: Subscriptions remain active until the end of the current billing cycle after cancellation. No refunds will be issued for unused time.
  • Immediate Termination: If you delete your account or your account is suspended due to violation of any terms, all active subscriptions will terminate immediately, and no refunds will be provided for the remaining period.
  • Billing Issues: In case of billing errors or other extraordinary circumstances, please contact our support team at support@abscribe.ai to request an evaluation of your case. Decisions regarding refunds are made at our sole discretion.

User Content

  • You retain ownership of all content you upload and generate.
  • You must not upload prohibited content, including but not limited to:
    • Pornography
    • Child abuse material
    • Content promoting terrorism or hate speech
  • We do not monitor or review user content but reserve the right to suspend accounts violating these Terms.

Features and Bugs

Our platform is designed with the aim of delivering the best experience based on user feedback and ongoing development. While we strive to meet diverse user needs, we do not guarantee that our Services will always align with every specific expectation or requirement.

While we test all new features thoroughly before release, we acknowledge that software may have bugs. We work diligently to address issues, particularly those related to security, privacy or functionality. However, we do not guarantee that all reported issues will be resolved immediately, nor can we promise that the Services will be free of errors at all times.

Service Availability

  • We strive to provide continuous service but may experience downtime for maintenance or unforeseen issues.
  • Scheduled maintenance will be communicated in advance.

Prohibited Uses

You agree not to:

  • Reverse engineer or copy our platform.
  • Use the service for illegal or unethical purposes.
  • Exploit vulnerabilities in the system.

Termination

We may suspend or terminate your access if you violate these Terms. Deleting your account terminates the agreement immediately.

Limitation of Liability

Abscribe.ai is provided "AS IS," without warranties of any kind, whether express or implied, regarding the platform's functionality, performance or results. To the maximum extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

You understand and agree that Abscribe shall not be responsible, under any circumstances, for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, business, goodwill, data, or other intangible assets, even if we were made aware of the potential for such damages. This includes damages resulting from:
i. your use or inability to use our Services;
ii. the cost of acquiring substitute products or services due to any transactions or activities carried out through or in connection with the Services;
iii. unauthorized access to or modification of your data or transmissions;
iv. any third-party actions or conduct within the platform;
v. or any other situation linked to these Terms or the Services, regardless of whether it arises from breach of contract, negligence, or another legal theory.

This limitation of liability applies as broadly as allowed by applicable law and survives the termination of these Terms.
